General Rules

These are the general rules you can expect to apply UNLESS an Exception occurs such as a contract, purchase of extra rights, or a discussion.

  • You are receiving a digital file, not printed art. I don't provide prints at the moment.

  • You are not permitted to edit, modify, or redistribute my art as your own without my express permission. You can edit and modify it on your own, but if you post it without my permission I will have an issue. Buying art from me, is simply paying me to create something from your imagination because you either want to support me, or you lack the skills to do so yourself - whatever the reason may be, you do not "own" it.

  • You may post the art on your social media and use it for whatever you like as long as it isn't for commercial use (see commercial rights). Just make sure to credit me in some way. Just a simple "Art by Anhel @artezahn." will suffice.

  • Please DO NOT remove my signature from the artwork. If you do not want me to place my signature on the artwork, you'll need to pay for that in the commissioning process.

  • Please do not fuss about my prices to me. If you don't think its worth the price, then find an artist whose price fits your worth. Dont be rude.

  • I use PayPal as my primary revenue manager. If you do not like or want to you paypal, we can discuss alternatives but absolutely NO VENMO, (I have had terrible experiences with them.)

  • I use a Half&Half Payment model. This generally consists of you paying me half of the cost of the entire commission upon commissioning me, and the other half when you receive your artwork. For a more detailed look, check my process above.

  • The estimated time periods that appear on the Commie Cards are just a generalization. Usually, the exact time will be negotiated and if not then you can resort to the period on the commie cards. The art doesn't have to take as long as the range shown, but will not take longer unless an exception occurs in which I'd have contacted you about before you start wondering.

  • The art example you see in the Commie Cards is the generally the quality you will be getting judging that you purchased that level of quality. Please note: I'm constantly learning and growing and quality may improve over time and they style may shift a bit. For the most recent artworks from me, check my Instagram; where I am most active.

Usage Rights

Here is a rundown of the terminology used regarding Usage rights and how these rights/rules apply to you

As the artist, I retain all intellectual rights to the produced artwork, unless expressly stated otherwise. Some examples include:

  • Displaying the pictures my websites or social media outlets. (I will give you credit as the owner of the character).

  • Promote myself with it in any desired venue.

  • Offer the digital files on Patreon, Gumroad, and/or other self promotion platforms.

  • Publish intellectual property contain said artwork. ex. Artbooks.

As the commissioner, you may:

  • Re-post the art on other sites with proper credit to me (with no commercial benefit).

  • Have the art printed out on merchandise as long as you aren't intending to resale that merchandise.

  • Use it as decoration for your own PERSONAL endeavors.

  • Edit and modify it, but not take ownership of it even if you modified it.

HOWEVER, please do not:

  • Take credit for the artwork's creation.

  • Use the artwork to generate any revenue. (See Commercial Rights for more info)

Important Terminology:

  • Personal Use: Posting, printing, framing, and or any other visual representation for something you want to see the artwork on just for decoration or as it is called"Educational" purposes only.

  • Commercial Use: Using the art as graphics on a website you intend to use to make profit with. Or placing the artwork on an item that is intended to again, generate some kind of revenue. In General, any kind of product or service. This includes posting the art as an advertisement or a means to garner recognition for a service you are trying to market or obtain money from. In today's landscape VTubing, Streaming, and Youtube Creators are popular methods of generating revenue for oneself and creating a "brand" around the internet personality you create. This is another instance where you'd need commercial rights to be able to use the artist's work without worrying about them being able to claim of of your revenue as their own. Requesting the commercial license from me will cost you an additional $75-$150 on top of the cost for the job.

  • Non-Disclosure (NDA): In the event that you do not want the artwork you've requested from me shown to the public, you can request a Non-Disclosure Agreement. I will then not show it any public setting and charge you an additional 50% fee. You'll then have my express written word, consenting that I have agreed not to show the commissioned work, (or i'll sign the NDA if that what you provide). This still doesn't mean that it is your "Intellectual Property". It just means I've agreed to respect your privacy and not show it. But if for example, you use the artwork for something you cannot go around telling people "I created this."

  • Intellectual Property: Any creation birthed from the mind of the creator who created it.

  • All Rights: I do have an option to surrender all rights to the creation. In this event, I will surrender all rights to the creation and you can do whatever you want with it and my name cannot be attached to it or anything that is created from it. The cost of this will be determined in conversation only.

Revisions

Sometimes Changes need to be made, lets talk about it

Revisions are free when:

  • I didn't follow a clear instruction or accidentally left out something that you paid to have in the artwork.

  • The change is very small and it just doesn't take anything off of me to fix it.

  • When I feel like making it free.

  • New Customers get 1 FREE Revision that would have been a paid revision otherwise (RULES APPLY, see "Free Revision Scope")

You need to pay for revisions when:

  • It's a major change to the artwork. (major changes are basically when I need to change the form of something, or add an entirely new entity that changes the drawing's composition.)

  • If you claim the free revision and you're still not happy, the next revision will begin to cost you starting from $25 - $50 (depending on the magnitude). This increases with repeat revision requests thereafter. The size of the change can increase the cost of the revision. If you want an addition to the requested art and its not something I left out, I may also ask for a small compensation depending on the magnitude of the change.

  • Free Revision Scope: The first free revision covers mostly anything except form changes. Example: A free revision will covers adding bows to a hair style. However, change the hair from dual ponytails to a single ponytail is a form change. In any event, just ask me :)

Refund & Cancellation Policy

  • Q. Okay so I got the final drawing now and....well I dont like anything about it. Can i get a full refund?

  • A That will never happen :)

  • Q. So the stars aligned and somehow I abhor this drawing with all my being, can I get a full refund?

  • A. In all honesty, while you are paying an artist for a piece of work, you are also paying them for their time to work for you. Hence by definition you shouldn't be able to refund it, because I already gave you all my time. BUT since I'm a decent guy here is my policy:

  • 1) No Requested revisions: - you will get back 50% of the original cost.

  • 2) 1 Revision requested: you will get back 25% of the original cost.

  • 3) 2 Revisions requested: No refunds.

  • Q. Why Is this your Refund Policy?

  • Because if you can hate the drawing that badly, then you probably knew revisions wouldn't help much and should consider not wasting anymore of my time asking for revisions and then expecting all of the compensation back. Again, the payment is primarily for the cost of performing a service for you. That's why its called compensation. My job is of course to try to please you to the best of my abilities, but sometimes that doesn't happen.

  • Q.Alright, say you have already worked on the project, but I want to cancel before you are finish, what happens then?

  • A. Your Refund amount will be based on the milestone i have passed working on your project. Once I have reached the end, the policy shifts to Refund Policy.

  • A) Sketch Stage: 80% Refund.

  • B) Flat Color Stage: 60% Refund

  • C) Character Rendered Stage: 50% Refund

  • I try my best to make sure my client are aware of what going on with their commissions to prevent alot of issues by maintaining a strong communication with them. However, sometimes things are out of my (or your) control, but hopefully we can come to an amicable agreement without bad blood. As always, contact me if you hve inquiries.

This concludes the Terms and Conditions portion of the document, if you have any questions, shoot a question to me via one of my socials.

The Official Commissioning Process

So you've decided to hire me? Well let dive into what to expect. Before you, is a fully detailed process outline on how our business relationship will begin and end. Please note that this is a generalization and not every single commission will follow the exact same procedure but it will be the general outline.Regardless of where you are coming from; the process begins after you've officially hired me to take on your commission. This is usually going to be via a Discord conversation or email where you'll be giving me all the details about what you want done. This includes; but is not limited to: How much you'll be paying, the estimated time-frame you need the work turned around, relevant details about the job, and any reference material you may have on hand.Once you're ready to lock in the job, I'll create a PayPal goods invoice and send it over to you in a timely manner. Now I use a Half&Half payment model and the invoice will reflect this. So what I'll do is, I'll try to get a sketch to you within 72hrs of the down-payment.You can look over it, point out what you do/don't like and Ill fix it up until you approve it. At this time is when you should tell me any grievances you have, because If you don't, cancellation can cost a fee after this step.At this point, things will slow down drastically as I'll be working on your commission is the following days/weeks. You may reach out to request W.I.Ps at anytime or just shoot me a question. Once the artwork is finished, I'll present the finished result at a lower resolution than you ordered. If all is well, you'll finish the remainder of the payment and ill deliver the final package and we go on our merry ways. This is my default case scenario. I'd also like to take this time to mention PayPal's service fees.As stated earlier, I will create an invoice and send these to my clients if we use PayPal (highly preferred payment method), However, Paypal does take a small commission when you do this; especially if you are overseas (I'm in the US). So I have to bill the client slightly higher to get the exact offered amount.I will give you a heads up about before you pay the invoice so you'll be aware of it.
I think that just about concludes the commission process. As always, if you have a question, run it by me via my socials and have a great day!
